M a rria g e    is   a n    im p o r­ta n t   so cial   in s titu tio n ,   a n d    it   p ro v id e s   n u c le u s   fo r  th e   fam ily  w hich  is  th e  b asic   u n it  o f   a   so ciety .     T ra d itio n a l   m a rria g e    w as   s h a p e d    by   valu es   p r e ­vailin g    in    a n c ie n t   tim e s.     T h e   m a in te n a n c e   o f  m ale  su p e rio rity   o v er  w om en w as  o n e   o f  such  valu es.     T h e  s tru c tu re    o f    th e    fa m ily ,    a n d    the   p ro c e ss   o f in te ra c tio n   betw een  th e   w ife  a n d   h u s b a n d ,  d e te rm in e   th e   v alues  they  ch erish   in th e ir   fam ily   life.     T o d a y    th is    h ie ra rc h ic a l   a n d    a u th o r ita r ia n    s tru c tu re     o f  fam ily  m u st  yield  p lace   to    a  s itu a tio n   o f   eq u a lity   a n d   m u tu a l  respect  b etw een th e   tw o   spouses.O n e   o f   th e    e ssen tials   o f    a    g o o d    g o v e rn m e n t   is  a   g o o d   system   o f law , w hich  is  c a p a b le   o f  p r o m o tin g   th e    p re fe rre d    v alu es   w ith o u t   giving   rise   to  d ish a rm o n y    a m o n g    th e  p e o p le   th a t  are  g o v e rn e d   by  it.     T h e   p u rp o s e   o f law  is  to    p ro m o te    ju s tic e ,   k e e p in g    p a c e    w ith    th e    c h a n g in g    social,   eco n o m ic, p o litic a l     a n d     o th e r    n e e d s   o f   th e    p eo p le. R e a ffirm in g    th ese   ideas,,   th e  P re a m b le   o f  o u r   C o n s titu tio n   speak s  o f  fo u r  o b je c tiv e s, viz.,   ju stic e ,  eq u a lity , lib erty   a n d   fra te rn ity ,  a n d   ru les  o u t  an y   k in d   o f  d is c rim in a tio n   o n   th e   basis  o f  sex,  race  a n d   religion.^     E v ery   b ra n c h   o f   law    s h o u ld     aim    a t   th e    re a lisa tio n  o f    these   objectives. M a trim o n ia l   law    is   n o    e x c e p tio n . In   th is  p a p e r  an  a tte m p t  is  m a d e   t o   ex a m in e   th e    q u e s tio n    h o w    f a r    th e    law    re la tin g    to    th e H in d u    M a rria g e    A c t,    1955   a n d    th e    law   la id   d o w n   in   th e   Special  M a rria g e  A ct,    1954   c o n tr ib u te    t o    b rin g    a b o u t   th e    p re fe rre d    social   change   in   th e p resen t  c o n te x t.
