The animal legal defense fund sends a notice of intent to sue under the endangered species act to the downtown aquarium and the department of the interior claiming the aqaurium's treatment of white tigers, an endangered species, on display in the aquarium deprives the tigers of room to run, exposure to outside air and causes the tigers harm and is thus illegal under the endangered species act. the notice of intent to sue is the first step in asking the department to act to protect the tigers. upon receipt of the letter, the aquarium sues the aldf for defamation in state court claiming the letter is defamatory. aldf files a motion to dismiss. after a hearing the judge will:
