A, B and C are partners, A being an industrial partner. During the first year of operation, the firm made a profit of P30,000. During the second year, a loss of P15,000 was sustained. Thus, the net profit for two years of operation was only P15,000. In the Articles of Partnership is was stipulated that A, the industrial partner would get 1/3 of the profits, but would not participate in the losses. Is the stipulation valid? Why?
