2. If you determine there is a contract between Ms. Hernandez and Ms. Washington, the next step is to evaluate the contract. Identify and explain whether there are any defenses to its creation or enforcement such that the contract is arguably voidable.
3. Discuss the Statute of Frauds and advise whether the agreement violates the Statute of Frauds. If you determine the agreement does violate the Statute of Frauds, explain why and discuss what, if anything can be done to the agreement to avoid a violation of the Statute of Frauds.
4. Since Ms. Hernandez’s negotiations and agreement with Ms. Washington took place electronically over email communication, we must consider the potential implications of this. Therefore, assess and identify all of the implications that exist, whether positive or negative, because this agreement was created in email form and nothing was reduced to documents that were physically signed by either party.
5. If you determine there is no contract, or if the contract is void, suggest what equitable remedies Ms. Washington could potentially pursue because she relied on the terms of the email exchange.
