Mr. Allan and Mr. Siwisa agreed to play $100, on a fifty-fifty basis on special numbers in the weekly lottery of St. Siven. They agreed to share the winnings and the losses, fifty-fifty. One week, Siwisa was late in paying half of the lottery fee. Allan paid the full $100 for the sheet of ticket. The special numbers won $1 million. Allan refused to share the winnings with Siwisa on the grounds that it was his money, and that Siwisa was late in paying his portion of the lottery fee.
