A lot of criminals may not have ever had a choice in the matter. For example, criminals who have been charged for selling drugs or other illegal substances may have 'had no other choice', while yes they did have a choice in the matter, during that time it could have been the only option for them to provide for their family and loved ones. When faced with hard choices and decisions, and it seems like there is no other option, people will do what they think will let them survive, even it is against their moral compass.
