Facts: Officers wanted to search Dollree Mapp's house, but she said no because they did not have a warrant. They were looking for a suspected bomber. Eventually, the police forced their way in. They did not find a bomber, but they did find a trunk of obscene pictures in the basement. Ms. Mapp was arrested and convicted for possession of obscenity. She appealed. Question for the court: Can you be convicted on the basis of illegally obtained evidence? Decision: No. The court held that evidence seized without a search warrant, could not be used in criminal prosecutions both in Federal and now State courts. This is called the Exclusionary Rule. Issue: Can the Exclusionary Rule cause a criminal to go free? Explain below in 2-4 sentences.
