Many states refused to ratify the constitution unless an assurance of amendments was given that it will be immediately proposed in the constitution.

Congress on 25 May, 1787 introduced a plan to draft new constitution in the constitutional convention held at Independence hall of Philadelphia. After a long debate moderated by President George Washington, the new constitution came into existence on 17th September , 1787 which was approved by 38 out of 41 delegates available at the cessation of the convention. As dictated in Article VII, the document will become binding only when it will be rectified by 9 out of 13 states .

By 7th December five territories - Delaware, Pennsylvania, New Jersey, Georgia and Connecticut agreed to approve it while other opposed stating the lack of constitutional protection of basic political rights like liberty of religion, speech and press. Later by February 1788, they reached a compromise with an assurance that amendment would be promptly proposed. Massachusetts was the first to approve it, later accompanied by Maryland and South Carolina. New Hampshire was the 9th state to approve it on 21 June and was acknowledged that government under U.S constitution would commence on March 4, 1789. In June, Virginia approved the constitution.New York approved it in July.

On 29th May, 1790 Rhode Island ratified it by 2 votes and at last 13 colonies also joined in making U.S constitution the oldest written constitution.
