EXPLANATION  

In Gideon v. Wainwright in 1963, the Supreme Court ruled that the Constitution required the state to provide lawyers as defenders for serious criminal offenses which could not afford to pay for lawyers themselves. The adoption of this ruling began in 1961 during the arrest of Clarence Earl Gideon. Gideon was punished as theft as he came in a billiard room and stole money from a vending machine from a billiard place in Panama City, Florida.  

At the time of the trial, Gideon was unable to bring in a lawyer himself. He then asked a lawyer for the state to represent him. The judge stated that Florida law only provides lawyers for poor defendants who potentially receive the death penalty.

Finally, the judge decided to sentence Gideon to five years in prison. After that, Gideon voiced the habeas corpus petition - petition for the release of prison sentences - to the Florida Supreme Court. He claimed that the sentence he received was unfair and not in accordance with the constitution because he did not get a lawyer who could defend him in court. Yet, the Florida Supreme Court rejected his petition. Gideon then appealed to the U.S. Supreme Court to review his case in 1963.
