On August 11, 1980, Shelby Memorial Hospital hired Sylvia Hayes, a certified X-ray technician, to work the 3:00 11:00 p. m. shift in the hospital’s radiology department. Two months later, she was fired after she informed her supervisor that she was pregnant. The supervisor fired Ms. Hayes because Dr. Cecil Eiland, the hospital’s radiology director and director of radiation safety, recommended that Ms. Hayes be removed from all areas using ionizing radiation, and the hospital could not find alternative work for her. After her dismissal, Ms. Hayes filed suit for violation of the Pregnancy Discrimination Act and Title VII. Should she recover?
