Nuco Plastics, Inc., was developing production molds for Universal Plastics, Inc. During the course of the development of the molds, Universal changed specifications and required the use of different materials. Nuco raised the price from $235 per 1,000 parts to $400 per 1,000 parts. Universal refused to pay the additional amount and ended the contract. Nuco was not paid for the molds it had produced and sued for breach of contract and damages. Universal maintained that Nuco had repudiated the contract by raising the price.
